2009 Official Sweepstakes Rules

1. SPONSOR:: THIS CAROLINA PRIDE CARWASH, INC SWEEPSTAKES (hereinafter “Sweepstakes”) IS SPONSORED BY CAROLINA PRIDE CARWASH, INC., 417 South Madison Blvd., Roxboro, NC 27573 (hereinafter “Sponsor”).

2. WHO CAN ENTER? NO PURCHASE NECESSARY: The Sweepstakes is open to all United States citizens of eighteen (18) years of age or order on February 1, 2009 and meet the eligibility requirements.

3. ELIGIBILITY REQUIREMENTS: The Sweepstakes is open to all individuals meeting the eligibility requirements. To be eligible an entrant, you MUST BE EIGHTEEN (18) years of age on or before February 1, 2009.

WHO CANNOT ENTER: To protect the integrity of the Sweepstakes, certain persons with relationships with the Sponsor are not allowed to participate, these include the employees of Carolina Pride Carwash, Inc., it’s affiliates, Participating Carwashes or members of their families (including spouse, children, parents, brothers, and sisters) living in the same household (whether related or not) as the employee ARE NOT ELIGIBLE. The Sweepstakes is subject to all state and Federal laws. Void where prohibited by law and in certain states where sweepstakes registration is required.

2. HOW TO ENTER: To enter the Sweepstakes, simply place a copy of your carwash receipt with your name and phone number in an official carwash sweepstakes entry box at a registered participating carwash. Each time you enter you increase your chances of winning. NO PURCHASE IS NECESSARY. You may also enter the Sweepstakes without placing a completed receipt in an official Sweepstakes entry box, by sending a self-addressed, stamped business size (#10) envelope to Carolina Pride Carwash, Inc.’s Sweepstakes, PO Box 488, Roxboro, NC 27573. Official alternative entry materials will be sent. Only valid official alternate entry forms will be accepted and each must be mailed separately. No reproductions will be accepted. All correspondence, including addressing, must be in Entrant’s personal handwriting. No machined and/or electronic correspondence shall be accepted. No mass/bulk mailing of any kind shall be accepted. Send the completed alternative entry forms to Carolina Pride Carwash, Inc. Sweepstakes, PO Box 488, Roxboro, NC 27573. All entries must be received by 10:00 a.m. EDT November 30th, 2009. No responsibility will be assumed for lost, misdirected, or late mail. The Sponsor reserves the right to amend and interpret these rules. No illegible, incomplete, forged or altered entries, or mechanically reproduced mail-in entries will be accepted. Sponsor and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, or misdirected entries or mail, for errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmissions lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Sponsor disclaims any liability for damage to any computer system resulting in participation in, or accessing or downloading information in connection with this Sweepstakes, and reserves the right, at its sole discretion, to cancel, terminate or suspend this sweepstakes should any virus bug, unauthorized human intervention or other causes beyond sponsor's control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE OR TAMPER WITH THE OFFICIAL SWEEPSTAKES ENTRY BOXES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION; AND IF SUCH INDIVIDUAL ENTERS THE SWEEPSTAKES HE/SHE WILL BE DISQUALIFIED.

3. GRAND PRIZE: There is One (1) Grand Prize and only One (1) Winner for the One Grand Prize. The One (1) Grand Prize is a 2009 Ford Fusion automobile. THE APPROXIMATE RETAIL VALUE (“ARV”) OF THE GRAND PRIZE IS $21,000. Prize is not transferable. No prize substitution or cash equivalent of prize will be given. Taxes on prizes are solely the winner's responsibility. In no event will more than one Grand Prize be awarded.

4. SELECTION OF THE WINNERS: The winner will be selected in a random drawing on December 10th, 2009 from all eligible entries received. The potential Grand Prize Winner will be determined by a random drawing conducted on or by December 10^th, 2009 by Harris Harvey Neal &Company LLC, a Certified Public Accountant (or other independent CPA designed by the sponsor), whose decision will be final. Their decisions are final and binding in all respects. By participating, entrants agree to abide by and be bound by the Official Rules and the decisions of the judges. The winner will be notified by phone approximately seven days after the drawing.

5. WINNERS' RESPONSIBILITIES: Winner is solely responsible for all other expenses not specifically set forth herein. Winner is solely responsible for registration, title and license fees, insurance, sales tax (except where prohibited by law), and all other unspecified costs associated with claiming, registering or using the here said prize(s). Winner will be required to sign an Affidavit of Eligibility, Liability Release, and a Publicity Release (except where prohibited by law) prior to issuance of prize. Winner is required to have insurance on the vehicle prior to delivery. Prize may awarded to alternate winner if affidavit is not returned within 14 days after mailing to winner or if prize notification letter or prize is returned as undeliverable.

6. ODDS OF WINNING: THE ODDS OF WINNING WILL DEPEND UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED.

7. HOW DO I KNOW IF I WON: The potential Grand Prize Winner will be notified by mail. Within five (5) days of notification the Grand Prize Winner must return an advertising/ publicity/liability release signed by the Grand Prize Winner. If a Grand Prize Winner or potential Grand Prize Winner declines to accept the prize, or in the event notification cannot be accomplished within ten (10) days of the first notification attempt, the Grand Prize Winner or potential Grand Prize Winner will be disqualified and the Sponsor will select an alternate Grand Prize Winner. The name and a photograph of the Grand Prize Winner will be published in at least one future issue of Carolina Pride Carwash, Inc.’s Newsletter, and will appear on the Sponsor’s website, www.CarolinaPrideCarWash.com. Winner’s name and hometown (not street address) may be listed in Sponsor’s publications, on it’s website, and in its releases to the press. All winners are responsible for applicable local, state, or Federal Taxes.

8. RELEASE: . By accepting prize the winner agrees to the Sponsor's use of his/her name and address (city & state), photograph, videotape or likeness for advertising or publicity purposes and to the use of statements made by or attributed to the winner relating to Sweepstakes or Sponsor, and grants to Sponsor any and all rights to said use, without further compensation or notice or notice, unless prohibited by law. In addition thereto, each entrant understands and agrees that the maximum liability and liquidated damages for the entire Sweepstakes is and shall be the ARV of the Grand Prize. All entries become property of the Sponsor, and no entries will be acknowledged. All entries have an equal chance of winning. By participating and/or by entering each entrant agrees: (a) to be to be bound by these Official Sweepstakes Rules; (b) that any claims and causes of action arising out of or in connection with the Carolina Pride Carwash, Inc.’s Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a Federal or state court within the State of NC; (c) that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Carolina Pride Carwash, Inc.’s Sweepstakes, but in no event shall such damages include attorneys’ fees; (d) that under no circumstances will an entrant be permitted to obtain awards for, and each entrant hereby waives all rights to, punitive, incidental, consequential, or other damages other than actual out-of-pocket expenses; (e) to release the Sponsor and hold the Sponsor harmless and their respective companies, affiliates and subsidiaries, and the officers, directors, shareholders, agents and employees of any of the above entities organizations from any and all liability, loss or damage incurred by participating in these Sweepstakes and/or the awarding, receipt, acceptance, possession or use/misuse of the prize. No entrant shall claim or receive any damages subject to being multiplied or otherwise increased. All issues and questions concerning these Official Sweepstakes Rules, or the rights and obligations of entrants or the Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice or law or conflict of law, rules or provisions (whether of the State of NC or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of NC.

9. INDEPENDENTLY OWNED AND OPERATED – Each of the locations where the Sweepstakes is promoted (hereinafter “Car Wash”) is independently owned and operated (hereinafter “Car Wash”). The Car Wash and Sponsor are not partners. The entrant, by entering, agrees to release the Car Wash and hold the Car Wash harmless and their respective companies, affiliates and subsidiaries, and the officers, directors, shareholders, agents and employees of any of the above entities organizations from any and all liability, loss or damage incurred by participating in these Sweepstakes and/or the awarding, receipt, acceptance, possession or use/misuse of the prize. In addition thereto, the Sponsor is not responsible for any thing, incident or accident that happens or may happen at a Car Wash location where the Sweepstakes is promoted.

INTERPRETATION OF RULES: These official Sweepstakes rules are subject to interpretation by the Sponsor. All determinations and interpretations by the Sponsor are final and binding on the Sweepstakes and all of the entrants.
